Terms of Sale & Use

These terms set out the agreement between you and us when you use projectvival or buy from us. Please read them before placing an order. By placing an order, you agree to these terms.

Who we are projectvival is a technology and design house operated by Esmond Solutions Pte. Ltd. (UEN 202031216G), a company registered in Singapore. Our registered office is 24 Sin Ming Lane, #01-100, Singapore 573970. In these terms, "we", "us" and "our" mean Esmond Solutions Pte. Ltd., and "you" means the customer. You can reach us at support@projectvival.com.

Using our website You may use this site for lawful, personal purposes only. You may not misuse the site, use it unlawfully, attempt to gain unauthorised access, or interfere with its operation. The projectvival and Vival names, logos, product designs, text, images and branding on this site are owned by or licensed to Esmond Solutions Pte. Ltd., and you may not copy, reproduce or use them without our written permission.

Our product The Vival Desk is a dual-motor electric standing desk, with a desktop measuring 120 × 60 cm, an adjustable height of 72–120 cm, a reinforced metal frame, and a maximum rated load of 100 kg. The desktop has a walnut finish, a walnut-look laminate over an MDF core. It is not solid wood and is not live-edge. Small natural variations in finish, colour and grain pattern are normal characteristics of the product and are not defects. Our published specifications are accurate, and the desk is sold as corresponding to this description.

Orders When you place an order, you make an offer to buy. A contract is formed only when we confirm acceptance of your order by email and payment is received. We may decline or cancel an order, for example if the item is unavailable, if there is a pricing error, or if we cannot verify payment. If you have already paid, we will refund you in full.

Cancelling your order You may cancel an order before it is dispatched at no charge for a full refund. Just email support@projectvival.com with your order number as soon as possible. Once an order has been dispatched, it is handled under our Refund & Return Policy. Please note that, under Singapore law, there is no statutory cooling-off or change-of-mind cancellation right for standard online retail purchases of goods. Any change-of-mind return we offer is a goodwill store policy set out in our Refund & Return Policy, not a legal entitlement. This does not affect your statutory rights for goods that are defective or do not conform to contract.

Prices and payment - The Vival Desk is priced at S$349, with free delivery within Singapore. An optional code VIVAL60 takes S$60 off at checkout, so you pay S$289. - All prices are in Singapore Dollars (SGD), and the displayed price is the final, all-in amount payable. There are no hidden surcharges. - Prices are inclusive of any applicable taxes. We are not GST-registered, so we do not charge GST, and no GST is added or shown at checkout, on invoices or on receipts. - We may change prices at any time, but changes do not affect orders we have already accepted.

Payment is taken at checkout through our third-party payment provider, HitPay (PayNow and card). HitPay acts as the payment processor; we do not ourselves capture or charge your card, and we do not see or store your full card details. HitPay is certified to PCI-DSS Level 1, supports 3D Secure, and is licensed under the Payment Services Act administered by the Monetary Authority of Singapore. These certifications and licences are held by HitPay, not by us.

If you believe a charge is incorrect, please contact us at support@projectvival.com before raising a dispute or chargeback with your bank, and we will work with you to resolve it quickly. Chargeback and dispute outcomes are ultimately governed by HitPay and the relevant card-network rules. We reserve the right to contest a chargeback where we hold evidence that an order was valid and fulfilled.

Delivery We currently sell and deliver within Singapore only. Delivery terms are set out in our Shipping Policy, which forms part of these terms.

Returns, warranty and your consumer rights Your order is covered by our Refund & Return Policy and by a 1-year warranty, set out on their respective pages. Nothing in these terms affects your statutory rights under Singapore law, including the Sale of Goods Act and the Consumer Protection (Fair Trading) Act (CPFTA) and its Lemon Law provisions. In particular: - The desk comes with the implied conditions that it is of satisfactory quality and corresponds with its description (including its material, dimensions and finish). We do not exclude these conditions. - If the desk does not conform to contract, you may first require us to repair or replace it free of charge. If we cannot do so within a reasonable time and without significant inconvenience to you, you may then claim a price reduction or a refund. - If a defect appears within six months of delivery, it is generally presumed to have existed at delivery unless we show otherwise. - Any voluntary warranty or returns policy we offer is in addition to, and does not replace or limit, these statutory rights. We do not operate any "no refunds", "all sales final" or "sold as is" terms.

Marketing communications Any marketing messages we send comply with the Spam Control Act 2007 and the PDPA Do Not Call provisions. How we handle marketing consent and opt-outs is described in our Privacy Policy.

Our liability We provide the Vival Desk with reasonable care. We are responsible for foreseeable loss caused by our breach or failure to use reasonable care, but we are not responsible for unforeseeable loss, or for loss caused by your misuse of the desk (including loading it beyond its rated 100 kg or making unauthorised modifications). To the fullest extent permitted by Singapore law, our total liability arising from any order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss. Nothing in these terms excludes or limits any liability that cannot lawfully be excluded (including liability for death or personal injury caused by our negligence, or for fraud), nor affects your statutory consumer rights.

Events outside our control We are not responsible for delays or failures caused by events beyond our reasonable control. If such an event occurs, we will let you know and work with you to find a fair solution.

Governing law These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over any dispute.

Changes to these terms We may update these terms from time to time. The version that applies to your order is the one published on this page at the time you placed it.
